Definitions

Acceptance of Terms

2.1. These terms apply to every Agreement regarding the use of PIA, regardless of how the Agreement is concluded (website, Chrome Web Store, or other channel).

2.2. By activating a subscription or using PIA, the Customer agrees to these terms. Changes to these terms will be published on the website and apply as soon as the Customer uses PIA again.

License & Restrictions

3.1. Provider grants the Customer a non-exclusive, non-transferable license to use PIA solely as described in the documentation.

3.2. The following is prohibited:

3.3. The Customer warrants that their use of PIA does not violate applicable laws or the terms of third parties (such as the Chrome Web Store).

Subscription & Payment

4.1. The Customer subscribes to PIA on a monthly or annual basis. The subscription automatically renews for each subsequent period unless cancelled in time.

4.2. Prices are exclusive of VAT. In the Netherlands, 21% VAT applies, unless international supply rules provide otherwise.

4.3. Payments are processed via Stripe. The Provider is not responsible for technical or operational failures at the payment provider.

Cancellation & Termination

5.1. The Customer may cancel their subscription via the subscription settings in the PIA app (Stripe portal). Cancellation takes effect at the end of the current billing period.

5.2. Provider may terminate the Agreement with immediate effect in the event of:

5.3. Upon termination, the Customer's license expires. Refunds are generally not provided unless required by law.

Liability & Disclaimer

6.1. Provider provides PIA "as is" and makes no warranty that PIA will function without interruption in all circumstances.

6.2. Provider's liability is limited to the amount the Customer paid to the Provider in the relevant calendar year, excluding indirect or unforeseeable damages.

6.3. Provider is not liable for damages resulting from configuration errors by the Customer, misuse, or force majeure events.

Intellectual Property

7.1. All intellectual property rights in and to PIA (including source code, design, logos, and trademarks) belong to the Provider.

7.2. The Customer does not acquire ownership or exclusive rights to the software, only the license as described in Article 3.

Privacy Policy

Buining Design (trading as PIA – Personal Intelligence Assistant) only processes personal data that is necessary for providing the service:

Data is processed on the basis of Article 6(1)(b) GDPR (necessary for the performance of the Agreement) and, where relevant, Article 6(1)(f) GDPR (legitimate interests of PIA regarding reliability, security, and service maintenance).

PIA does not share personal data with third parties, except for:

PIA will respond within the legally required period of 30 days. You may also lodge a complaint with the Dutch Data Protection Authority (AP).

General Provisions

9.1. Changes to these terms will be published on the website and apply from the moment the Customer uses PIA again.

9.2. The laws of the Kingdom of the Netherlands apply. In case of disputes, the court in Amsterdam has jurisdiction, unless mandatory rules provide otherwise.

9.3. If any provision of these terms is void or unenforceable, the remaining provisions remain in effect. PIA will then formulate a new, reasonable provision that approximates the original purpose as closely as possible.
